Bộ trưởng Phạm Bình Minh: Là quốc gia ven biển, Việt Nam đã tham gia Công ước Liên Hợp Quốc về Luật Biển năm 1982 từ năm 1994. Tuy nhiên, cho đến nay, Việt Nam chưa có một văn bản luật về biển mà chỉ mới có các quy định trong một số văn bản pháp quy liên quan.

Với việc thông qua Luật Biển Việt Nam, lần đầu tiên nước ta có một văn bản luật quy định đầy đủ chế độ pháp lý của các vùng biển, đảo thuộc chủ quyền và quyền chủ quyền của Việt Nam theo đúng Công ước Liên Hợp Quốc về Luật Biển năm 1982. Đây là cơ sở pháp lý quan trọng để quản lý, bảo vệ và phát triển kinh tế biển, đảo của nước ta.
Với bờ biển dài và các vùng biển rộng lớn, kinh tế biển đóng vai trò hết sức quan trọng đối với sự nghiệp xây dựng và phát triển của ta. Việc xây dựng và ban hành Luật Biển Việt Nam là nhu cầu tất yếu nhằm phục vụ công cuộc phát triển kinh tế của Việt Nam.
Bộ trưởng có thể cho biết khái quát về quá trình xây dựng và những nội dung chính trong Luật Biển Việt Nam?
Bộ trưởng Phạm Bình Minh: Quá trình xây dựng Luật Biển Việt Nam được bắt đầu từ năm 1998 và đã trải qua 3 nhiệm kỳ Quốc hội các khóa X, XI, XII. Luật Biển Việt Nam là một luật có nội dung rất lớn, liên quan đến nhiều lĩnh vực, đòi hỏi phải có sự chuẩn bị công phu, kỹ lưỡng. Luật được xây dựng trên cơ sở Hiến pháp, Nghị quyết của Quốc hội về phê chuẩn Công ước Liên Hợp Quốc về Luật Biển năm 1982, các Tuyên bố của Chính phủ năm 1977 và 1982, tổng kết thực tiễn quản lý biển của nước ta, trên cơ sở Công ước Liên Hợp Quốc về Luật Biển 1982 và các Hiệp định về biển đã ký. Trong quá trình xây dựng Luật Biển Việt Nam, ta cũng đã tham khảo thực tiễn của các nước và cũng cân nhắc lợi ích của ta, lợi ích của các bên liên quan ở Biển Đông và lợi ích chung của khu vực.
Luật có 7 chương đề cập đến các nội dung chủ yếu sau: các nguyên tắc, chính sách quản lý và bảo vệ biển; phạm vi và quy chế các vùng nội thủy, lãnh hải, vùng tiếp giáp lãnh hải, vùng đặc quyền kinh tế, thềm lục địa; quy chế các đảo, quần đảo Việt Nam; các hoạt động trong vùng biển Việt Nam; tìm kiếm, cứu nạn, cứu hộ; bảo vệ tài nguyên và môi trường biển; nghiên cứu khoa học biển; phát triển kinh tế biển; tuần tra kiểm soát trên biển; hợp tác quốc tế về biển.
Thưa Bộ trưởng, theo những quy định hiện hành, có nhiều bộ, ngành có chức năng quản lý biển. Vậy Luật Biển Việt Nam có quy định về chức năng nhiệm vụ quản lý biển của các bộ, ngành?
Bộ trưởng Phạm Bình Minh: Quản lý nhà nước về biển là một lĩnh vực rộng lớn, liên quan đến chức năng nhiệm vụ của nhiều bộ, ngành và địa phương trong cả nước. Hiện nay, phạm vi thẩm quyền cũng như cơ chế phối hợp của các bộ, ngành, các lực lượng tham gia quản lý biển được quy định cụ thể trong các văn bản pháp quy liên quan và được đặt dưới sự điều hành thống nhất của Chính phủ.
Luật Biển Việt Nam là một luật khung quy định các nguyên tắc lớn đối với các vấn đề liên quan đến biển nên không nêu cụ thể, chi tiết chức năng của từng bộ, ngành tham gia quản lý biển. Luật khẳng định Chính phủ thống nhất quản lý nhà nước về biển trong phạm vi cả nước. Các bộ, ngành và địa phương thực hiện quản lý biển trong phạm vi nhiệm vụ, quyền hạn của mình.
Vấn đề chủ quyền, quyền chủ quyền đối với các vùng biển, đảo được thể hiện thế nào trong Luật Biển Việt Nam?
Bộ trưởng Phạm Bình Minh: Phù hợp với các quy định trong Công ước Liên Hợp Quốc về Luật Biển năm 1982, Luật Biển Việt Nam quy định rất rõ các vùng biển của Việt Nam, bao gồm nội thủy, lãnh hải, vùng tiếp giáp lãnh hải, vùng đặc quyền kinh tế và thềm lục địa. Việt Nam thực hiện chủ quyền đối với các vùng nội thủy và lãnh hải; thực hiện quyền chủ quyền và quyền tài phán quốc gia đối với vùng đặc quyền kinh tế và vùng thềm lục địa.
Chủ quyền của Việt Nam đối với các đảo, trong đó có hai quần đảo Hoàng Sa và Trường Sa, đã được nêu tại một số quy định trong các văn bản luật đã có trước đây, như Luật Biên giới quốc gia năm 2003, tiếp tục được thể hiện rõ trong Luật Biển Việt Nam.
Luật quy định rõ là mọi tổ chức, cá nhân phải tôn trọng chủ quyền, toàn vẹn lãnh thổ, quyền chủ quyền, quyền tài phán quốc gia và lợi ích của Việt Nam, tuân thủ các quy định của pháp luật Việt Nam khi hoạt động trong các vùng biển của ta. Mọi vi phạm các quy định pháp luật liên quan đến biển, đảo của Việt Nam đều bị xử lý theo pháp luật liên quan.
Nước ta còn có một số bất đồng, tranh chấp về biển, đảo với một số nước láng giềng. Trong Luật Biển Việt Nam, vấn đề này được đề cập như thế nào, thưa Bộ trưởng?
Bộ trưởng Phạm Bình Minh: Luật Biển Việt Nam quy định rõ Nhà nước Việt Nam chủ trương giải quyết các bất đồng, tranh chấp liên quan đến biển, đảo với các nước khác bằng các biện pháp hòa bình, trên cơ sở tôn trọng độc lập, chủ quyền và toàn vẹn lãnh thổ quốc gia, phù hợp với Công ước Liên Hợp Quốc về Luật Biển năm 1982, pháp luật và thực tiễn quốc tế.
Đây là chủ trương nhất quán của Nhà nước ta. Chúng ta đã, đang và sẽ kiên trì thực hiện chủ trương này. Trên thực tế, đến nay chúng ta đã giải quyết được một số tranh chấp với các nước láng giềng. Ví dụ năm 1997, ta cùng Thái Lan phân định vùng đặc quyền kinh tế và thềm lục địa; năm 2000, cùng Trung Quốc phân định lãnh hải, vùng đặc quyền kinh tế và thềm lục địa trong Vịnh Bắc Bộ; năm 2003, cùng Indonesia phân định thềm lục địa…
Tôi cho rằng với việc Quốc hội nước ta thông qua Luật Biển Việt Nam, chúng ta đã chuyển một thông điệp quan trọng đến cộng đồng quốc tế. Đó là: Việt Nam là một thành viên có trách nhiệm trong cộng đồng quốc tế, tôn trọng và tuân thủ luật pháp quốc tế, nhất là Công ước Liên Hợp Quốc về Luật Biển năm 1982, phấn đấu vì hòa bình, ổn định, hợp tác và phát triển của khu vực và trên thế giới.

Luật Biển Việt Nam gồm 7 chương, 55 điều, có hiệu lực thi hành từ ngày 1/1/2013. Chương 1 gồm các quy định chung về phạm vi điều chỉnh, định nghĩa. Chương 2 quy định về vùng biển Việt Nam với các quy định về đường cơ sở, nội thủy, lãnh hải, vùng tiếp giáp lãnh hải, vùng đặc quyền kinh tế, thềm lục địa, đảo, quần đảo… Chương 3 quy định về hoạt động trong vùng biển Việt Nam, trong đó có các quy định: đi qua không gây hại trong lãnh hải, tuyến hàng hải và phân luồng giao thông trong lãnh hải phục vụ cho việc đi qua không gây hại, vùng cấm và khu vực hạn chế hoạt động trong lãnh hải, tàu quân sự và tàu thuyền công vụ của nước ngoài đến Việt Nam, trách nhiệm của tàu quân sự và tàu thuyền công vụ của nước ngoài trong vùng biển Việt Nam, hoạt động của tàu ngầm và các phương tiện đi ngầm khác của nước ngoài trong nội thủy, lãnh hải Việt Nam, quyền tài phán hình sự và dân sự đối với tàu thuyền nước ngoài, quyền truy đuổi tàu thuyền nước ngoài… Chương 4 dành cho phát triển kinh tế biển, với các điều khoản về nguyên tắc phát triển kinh tế biển, các ngành kinh tế biển, quy hoạch phát triển kinh tế biển, xây dựng và phát triển kinh tế biển, khuyến khích, ưu đãi đầu tư phát triển kinh tế trên các đảo và hoạt động trên biển. Chương 5 quy định về tuần tra, kiểm soát trên biển với các điều khoản về lực lượng tuần tra, kiểm soát trên biển, nhiệm vụ và phạm vi trách nhiệm tuần tra, kiểm soát trên biển, cờ, sắc phục và phù hiệu.
